Court safeguards for unclaimed estate money
Beginning November 1, 2025, the law sets court-supervised rules for holding estate money until the proper person can collect it. When a minor has no qualified guardian within 90 days after the distribution order, the estate's manager must seek court approval. The order names an Oklahoma bank or financial institution and sets a deposit term. The county treasurer holds the money in trust for release to a qualified guardian or the minor at age 18. Courts can also order deposits with the treasurer when an heir or other recipient cannot be found or refuses payment within 90 days. That money stays in trust until a legal or personal representative claims it. If an heir dies and no personal representative is available within 90 days, courts can place the money with the clerk. For clerk-held funds over $100, after 30 days without a claim, the clerk may use federally insured savings accounts or certificates of deposit. The rightful recipient receives the money and any earnings after providing a full written receipt, filed in the case records. Funds still held when a treasurer's or clerk's term ends pass to the successor.
