Paid family care for young Medicaid members
The law creates an Oklahoma Medicaid program for paid care by recognized family caregivers, subject to federal approval. Members must be under 21 and approved for private-duty nursing or paid family caregiver benefits instead of that nursing. Family caregivers can include relatives, spouses, and other closely related or closely associated people. They can perform allowed skilled-care tasks through a licensed home care agency, under a registered nurse’s direction and supervision. The State Board of Health sets caregiver qualifications and allowed tasks, including required criminal history background checks. Home care agencies must ensure caregivers meet these requirements. The Oklahoma Health Care Authority sets reimbursement rates paid to agencies; the law does not specify a caregiver pay amount. The Authority must seek federal approval and establish the program within one year of the law’s effective date. The law lists July 1, 2025, as its effective date and also says its emergency clause makes it effective upon passage and approval.
