Named Oklahoma institutions fall outside technology rules
The law excludes several institutions from the state-agency coverage of Oklahoma’s Information Technology Consolidation and Coordination Act. These include state higher education institutions, the Oklahoma State Regents for Higher Education, and the Oklahoma Municipal Power Authority. Also excluded are the Oklahoma State Bureau of Investigation, District Attorneys Council, Attorney General’s Office, and State Auditor and Inspector’s Office. The OneNet telecommunications network is also outside this coverage.
Oklahoma agencies can share software
Covered Oklahoma agencies can provide software through shared services, but the law does not require them to use shared software. The law defines technology assets to include hardware, software, firmware, services, and related resources. These services include support, consulting, and software development. The definition also covers telecommunications fiber networks that carry electronic communications or information between locations.
Agency technology hiring expands with oversight
Covered agencies can employ technology staff to develop and carry out their technology plans. Before hiring or keeping these staff, both the agency and state chief information officer must sign an agreement. It must cover positions, duties, qualifications, security and data integrity oversight, and any other terms either party requires. Agencies remain subject to the chief information officer’s standards and policies; the officer can audit compliance. This hiring authority does not exempt agencies from the Act’s other rules. The law took effect immediately upon passage and approval.
