All utilities must join dig center

All operators of underground lines in Puerto Rico must join the Excavation and Demolition Coordination Center. They must give the Center a contact name and phone number to get dig notices. Before any scheduled excavation or demolition, operators must mark the line’s location and about how deep it is. The Center sets the colors and other marking methods by regulation.

Fast rules with due process safeguards

The Public Service Commission must issue needed rules within 90 days and adopt full regulations within 6 months. The law works even if rules are not yet written. Any regulation must follow Puerto Rico’s uniform procedure law and the due‑process standard from Memphis Light v. Craft. This speeds implementation and protects people’s rights.

Municipal fee relief and repair power

Beginning in fiscal year 2025-2026, municipalities do not owe the one-time startup contribution. Regulators cannot add any new fees on municipalities by rule unless a specific law allows it. If a Puerto Rico government operator fails to follow the law when it works in municipal infrastructure, the municipality can require that operator to repair the damage under the Municipal Code.

Operator fees to fund dig center

Each operator of underground lines must pay a one-time initial contribution, due within 60 days after approval of the law. Any new operator that starts after the law takes effect must also pay that initial contribution, with details set by regulation. The Transportation Secretary can set service fees for operators, excavators, or demolishers by rule. All money collected goes into a special fund used only to run and support the Coordination Center.
