Bill Overview

Analyzed Economic Effects

4 provisions identified: 4 benefits, 0 costs, 0 mixed.

Dialysis patients' rights and consent rules

The law applies to all public and private hospitals and clinics that give dialysis in Puerto Rico. You have the right to be treated with respect and dignity. You must receive clear counseling and information about your care. No one can use you for research or teaching without your written consent. If you cannot consent, your tutor or parents with legal parental authority must sign.

Patient Ombudsman enforcement and fines

You can file a complaint with the Patient Ombudsman if your dialysis rights are violated. The Office receives and investigates these complaints. Facilities that break the law face a civil fine of $500 to $10,000 for each violation.

Rights posters and patient acknowledgment required

The Department of Health makes a 17 by 24 inch poster that explains dialysis patient rights. Hospitals and centers that treat dialysis must display the poster in a prominent place. They must have a copy of the law for you to read before treatment. They must record in your medical record, using the official form, that you read the law before dialysis.

Separate companion area at dialysis centers

Dialysis centers with the required Puerto Rico permits must provide a separate area for companions. This area is different from where dialysis treatment happens. It is a designated space for patient companions.
