Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 0 costs, 3 mixed.

Bargaining rights for self-directed caregivers

Self-directed caregivers can choose one statewide representative to bargain over pay, benefits, training, and payment rules. The State must meet within 30 days and negotiate in good faith, and any deal is put in writing. If talks stall, Rhode Island’s impasse process applies, and the certified group must fairly represent all caregivers. Members can allow dues to be taken from their payments. Caregivers may not strike or stop services together. Bargaining under this law is protected by a state antitrust shield.

Medicaid services protected during bargaining

Bargaining deals cannot cut federal Medicaid matching funds or reduce self-directed personal care services. Parts of any deal that need new state or federal money, or law changes, start only after those are passed. This protects Medicaid funding and services, but pay or benefit changes that need extra money wait for the budget.

How caregivers choose a representative

Petitions to certify a provider group go to the Labor Relations Board. An election happens when at least 10% of caregivers show interest. All self-directed caregivers vote by secret ballot, and a majority of votes cast picks the representative. Family and in‑home domestic caregivers are included and can be represented.

Provider groups get contacts, share costs

Within 90 days, the State must give each previously certified provider group contact info for all self-directed caregivers and update it every 60 days. When more than one group is on a certification ballot, those groups split the election costs equally.
