Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

High radon? Seller must fix before closing

If a required test shows more than 4.0 pCi/L, the seller must install a radon mitigation system. A certified or licensed professional must do the work. The seller pays for the system and for a follow-up test. Both the installation and the follow-up test must be done before closing. The buyer may request an extra test at the buyer’s own cost.

Radon test required before home sale

Most home sales now require a certified radon test before a binding purchase and sale deal. The test must be done no earlier than one year before closing. Results go to the seller, the buyer, and any lender named by the buyer. The seller pays for this test. The buyer may order another test at the buyer’s expense. The rule covers homes sold for residential use, not commercial or tourist/transient use. It does not apply to foreclosures, sheriff’s or tax sales, court-ordered sales, homes to be demolished or converted, or transfers by inheritance.
