Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Stronger protection from uninsured drivers

The law sets your uninsured motorist bodily injury limit equal to your policy’s bodily injury liability limit for cars registered or garaged in Rhode Island, unless you select lower limits as allowed. It treats an underinsured at-fault driver as uninsured, so you can use this coverage when their limits are too low. You do not have to sue the at-fault driver before claiming from your insurer. If you paid separate uninsured motorist premiums to the same company, you can add the limits together, even across policies.

Pick your uninsured coverage limits

The named insured can choose lower uninsured motorist limits in writing, but not below the state minimums. If you buy only the state’s minimum required coverage, you may drop uninsured motorist coverage to zero only after signing a director‑approved warning notice. At renewal or policy changes, your insurer must tell you about uninsured motorist options and higher limits. You can ask in writing for higher or added uninsured motorist coverage at those times.

Property damage choices and costs

You may reject uninsured motorist property damage coverage in writing. If you carry collision coverage, this property damage coverage is not required unless you buy it. The default deductible for uninsured motorist collision property damage claims is $200 per claim unless you and the insurer agree to a different amount. To make a property damage claim under this coverage, you must identify the at-fault driver and show they had no insurance. The insurance commissioner sets this coverage’s rate as a percentage of the base collision rate.
