Higher costs to restore driving privileges

Drivers restoring their driving privileges pay a reinstatement fee plus the normal application fee after their revocation, suspension, or disqualification ends. The reinstatement fee is $100 for convictions under §32-23-2; $150 under §32-23-3; and $200 under §§32-23-4, 32-23-4.6, or 32-23-4.7. It is $125 under §32-33-18 or for a second or later §32-24-1 conviction within one year. It is $225 under §§22-16-41 or 22-18-36, and $75 when none of the listed categories applies. The fee exemption covers prior restricted minor permit, motorcycle restricted minor permit, and instruction permit holders, and suspensions solely under §32-12-15. That exemption does not apply when the suspension involves a moving traffic offense worth six or more points. Revocations listed in §32-12-47.1(1)(a)–(e) also require the knowledge test for new applicants. Revocation or suspension periods generally start on the earlier court-ordered date or department notice date, including the effective suspension date for citation noncompliance. After revocation ends, applicants must file required proof under chapter 32-35. The department may investigate their character, habits, and driving ability before issuing a license. Licenses issued after specified revocations must show court-ordered restrictions and their expiration dates.

Higher fees for commercial driver licenses

A South Dakota commercial driver license application costs $43. Each endorsement knowledge test costs $20. A duplicate commercial license, name change, or address change also costs $20. These fees go to the state motor vehicle fund.

Higher fees for everyday driver licenses

In South Dakota, an original or renewed driver license costs $38. A duplicate license, name change, or address change costs $20. These fees go to the state motor vehicle fund. Of each $38 fee, $5 pays for Highway Patrol administration.

Driver record access carries higher fees

The law expands driver-record access while charging $7 for each covered request. Problem driver system records must include all adverse license actions held by a jurisdiction. Their release must follow federal rule 23 C.F.R. §1327, as of January 1, 1995. Certified records for people covered by chapter 32-35 cover three years of accidents, medical certification status, and convictions. Employers and prospective employers can get three-year records for commercial license or commercial learner's permit holders with their written consent. Drivers can also request their own records; these disclosures include medical certification, disqualifications, and licensing actions, but exclude parking violations. Government entities and subdivisions pay none of these record fees, and collected fees go to the state motor vehicle fund.
