New court rules for recorded child interviews
Effective upon enactment, Tennessee law changes when recorded child forensic interviews can be used in court. The child or interviewer must swear that the video is a true and correct recording of the events shown. The child must also be available for questioning by the other side about the interview. Interviews from child advocacy centers meeting state requirements are not excluded solely because the interviewer works for that center. The law also allows specific exceptions to those center requirements. A center without nonprofit status qualifies if it has accreditation from a nationally recognized agency. A director who does not meet state criteria qualifies if supervised by a publicly elected official. A center missing an agreement and working protocol with all local law enforcement agencies qualifies through an alternative agreement. That agreement and protocol must be signed by the center, the Department of Children’s Services, and a district attorney general. Federal-agency interviewers also qualify when conducting the interview during a federal crime investigation.
