DNA submissions expand for deceased offenders

Beginning July 1, 2025, law enforcement agencies, including Tennessee corrections, may submit DNA samples from deceased offenders with qualifying convictions. Agencies may submit only lawfully obtained samples they control to the Tennessee Bureau of Investigation. They must submit a sample when a qualifying offender dies while incarcerated and no sample was previously submitted. Both rules apply regardless of when the conviction occurred. The bureau maintains these samples under existing state law.

Faster DNA collection from sentenced people

Beginning July 1, 2025, Tennessee requires covered DNA samples to be collected within 30 days after sentencing. If incarceration lasts less than 30 days, collection must happen before the term ends. The corrections commissioner or local jail chief must order missing samples from people convicted of felonies or covered misdemeanors. This applies to people imprisoned in state corrections custody or sentenced to a county jail or workhouse. The collecting agency must send samples to the Tennessee Bureau of Investigation, which maintains them under existing state law.
