New deadlines for UCC dispute filings

The filing office must send a UCC petition, the financing statement, and the notarized affidavit to the Secretary of State’s hearing division within three business days and request a hearing. When an administrative law judge issues a decision, the secured party must send a copy to the filing office. The public official who filed the affidavit must also send a copy of the decision. If the secured party files a court petition for judicial review, they must give a copy to the filing office within seven days. These rules take effect immediately.
