New deadlines for disputed financing filings
The law sets document-sharing rules for reviews of disputed Uniform Commercial Code financing statements in Tennessee. After receiving a review petition and cost bond, the filing office must forward the required papers within three business days. These include the petition, challenged financing statement, and public official’s notarized affidavit, plus a hearing request. They go to the Secretary of State’s Administrative Procedures Division. The secured party must send the filing office the judge’s determination under subsection (e)(7); the official must do so under subsection (e)(8). A secured party seeking court review of an (e)(8) determination must send the filing office its petition within seven days of filing. The law takes effect upon becoming law.
