Tougher penalties for aggravated sexual battery

Beginning July 1, 2025, aggravated sexual battery is a Class B felony in Tennessee. If the victim was under 18, or was mentally defective, mentally incapacitated, or physically helpless, the defendant must receive at least a Range II sentence. Judges may give a higher Range III sentence when appropriate. No sentence in these cases can be below Range II.
