Higher sentences for aggravated sexual battery offenders
Beginning July 1, 2025, Tennessee requires at least Range II sentencing for aggravated sexual battery involving specified victims. This applies when the victim was under 18, mentally defective, mentally incapacitated, or physically helpless. Courts may impose a Range III sentence when appropriate, but cannot go below Range II despite ordinary sentencing rules. Aggravated sexual battery remains a Class B felony in all cases.
