Tennessee bans child sexual abuse tools
Beginning July 1, 2025, Tennessee bans knowingly possessing, distributing, or producing technology, software, or digital tools designed to create specified material. This covers material showing a minor in sexual activity or patently offensive simulated sexual activity. Possession is a Class E felony, distribution is a Class C felony, and production is a Class B felony. To decide a tool's purpose, courts must consider the defendant's statements and possession of such material. They must also consider instructions, descriptive materials, how the tools were advertised or offered, legitimate community uses, and expert testimony. Courts must consider these factors along with any other relevant factors.
