New felonies for child sexual image tools

The law makes it a crime to knowingly have, share, or make technology, software, or digital tools designed to create material with a minor in sexual activity or simulated sexual activity that is patently offensive. Having those tools is a Class E felony. Sharing them is a Class C felony. Making them is a Class B felony. Courts must weigh things like the defendant’s statements, any such material found, instructions or ads for the tool, real lawful uses, and expert testimony to decide intent. The law takes effect July 1, 2025.
