Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Public safety workers gain record access

Tennessee public safety employers requiring mental health checks must give workers and applicants reasonable access to their full employment records. This includes check results and evaluator reports; access can be limited to normal business hours. Covered jobs include policing, firefighting, emergency care, rescue work, and licensed or registered private security work. Coverage includes paid workers and volunteers, but excludes self-employed independent contractors, and applies to government and private employers. Tennessee confidentiality rules still apply to these records. Employees—not applicants—can sue over denied access and ask a court to declare their rights or order relief. Employees who win receive reasonable court costs and attorney fees. The law took effect upon becoming law.

Public safety applicants get second-review rights

Tennessee public safety applicants rejected partly or fully because of a required mental health check can submit an equivalent second review. A qualified mental health professional authorized to conduct employment evaluations must perform it. Applicants pay for this review themselves. The employer may reevaluate the applicant using the new results; submitting them does not guarantee a job.
