In counties that adopt this section, you must state on plats, site plans, and building permits whether you seek annexation for land outside the city but inside its urban growth boundary. If you seek annexation, you must build to the city’s standards. If you do not, the county records your declaration with the register of deeds. The property cannot be annexed later unless you or a future owner sign and record an agreement to pay a special assessment to bring the property up to city infrastructure standards. That agreement binds current and future owners.
In counties with fewer than 341,500 people and no metro government, cities and regional boards cannot zone land outside city limits. This takes effect only after the county commission passes a resolution by majority vote. Once adopted, any city zoning that reached outside city limits is void and unenforceable. The county and city may sign interlocal deals to finish or wind down projects, and a developer can join with both boards’ consent. The law still allows counties and cities to make interlocal agreements for any lawful purpose.
