Effective upon becoming law, the law creates Tennessee’s children’s digital protection fund for state residents under age 18. It receives state money from resolved legal claims about social media, online gaming, or other digital technology harming minors’ mental health and wellbeing. The attorney general controls deposits and calculates net recoveries after investigation costs, lawsuit costs, attorney fees, and restitution amounts are deducted. The Tennessee General Assembly must approve spending, which is limited to the purposes listed in the law. Approved uses include minors’ mental health services, research, education, suicide prevention, and deposits into the kindergarten-through-grade-12 mental health endowment fund. Money can also support criminal and civil law enforcement addressing digital harms to minors’ mental health and technology-based exploitation. The fund can receive money from other sources. Investment interest stays in the fund, and unspent money carries forward rather than returning to the state’s general fund.
