Consent-based drug tests for suspected shooters

This process applies to mass shootings on or after July 1, 2026. Officers with probable cause to believe someone committed a mass shooting may ask for a blood or urine test. Testing requires consent; for minors, only a parent or legal guardian can consent. With consent, officers must arrange hospital testing by qualified medical or laboratory staff, with prompt sample collection unless life is in danger. Tests check for drugs, including therapeutic levels of psychotropic drugs, which affect mood, thinking, or behavior. Hospitals must send results without identifying details to the health science center. The center must use available software to study drug interactions and include the data in quarterly reports to legislative clerks. Officers retain their authority to obtain search warrants.

Liability protection for hospital sample collection

For mass shootings on or after July 1, 2026, hospitals and qualified practitioners gain protection when collecting samples under this process. They face no civil or criminal liability for collecting blood or urine, except when negligence occurs. Practitioners are presumed to act in good faith once consent is acknowledged.

More shootings qualify for drug studies

For shootings on or after July 1, 2026, Tennessee expands which cases qualify for mass-shooting drug studies. A shooting qualifies when at least four people are injured. It also qualifies when a reasonable person concludes that the person who died tried to kill at least four people. The law removes the old requirement that at least four people die.
