Beginning May 6, 2026, the law bans driving on Utah highways if any fuel tank has dyed diesel. Exemptions cover uses allowed by federal law; travel only between your own farm parcels for needed farm work; and special mobile equipment moved incidentally for construction. Fines are the greater of $500 or $5 per gallon per tank for a first offense, and $1,000 or $10 per gallon per tank for later offenses, using each tank’s maximum capacity. These fines are on top of other taxes and go to the Utah Transportation Fund. The commission can waive or reduce a fine for reasonable cause and must make a record of the action.
Beginning May 6, 2026, officials cannot sample your fuel without probable cause, your consent, or a port‑of‑entry check. Driving a diesel vehicle alone does not create probable cause to search your tank. These rules limit surprise fuel inspections for dyed diesel.
