New fund for state prison construction

Beginning May 6, 2026, the state creates a restricted account for prison construction and expansion. The account includes parts of new Department of Corrections appropriations for capital facility costs, interest and other earnings, and any deposits the Legislature makes. Starting the second fiscal year of a bill’s implementation, one‑time savings from delayed prison population cost estimates also go in. Lawmakers may use this money only to expand existing state correctional facilities or build new ones. This act does not put any money into the account.

When this law takes effect

The law sets May 6, 2026 as the default start date. If two‑thirds of both houses approve an earlier effective date, it can take effect sooner. It then starts when the governor signs, the day after the allowed time if unsigned, or on the day a veto is overridden. These timing rules control when the fund and its limits begin.
