Counties must post digital recording rules

Starting May 6, 2026, any county that accepts digitally authenticated records must keep written procedures for both digital and traditional documents. The county must tell the public which digital methods it accepts, keep audit trails, and follow the archivist’s retention rules.

Counties need approval to record digital documents

Beginning May 6, 2026, a county can record digitally authenticated documents only after the State Archives approves its system. The county must submit a proposal that explains security, verification, and the types of records it will take. The proposal is presented in a public meeting, and the archivist decides within 45 days. Approvals last three years and can be renewed if the county stays in compliance.

Keep digital records verifiable and accessible

Starting May 6, 2026, government entities must keep digitally authenticated records per approved retention schedules and preserve the data needed to verify them. They must transfer records to the State Archives when required, unless another law blocks the transfer. The state archivist sets procedures to accept permanent digital records, verify their authenticity, preserve their digital features, and give public access under Utah’s public records law.

State sets rules for trusted digital records

Beginning May 6, 2026, the State Archives sets technical standards for digital authentication systems. Rules cover security, tamper‑evidence, identity checks, verification data, retention, and formats that last. The archivist makes these rules under the state rulemaking act and consults the tech division and industry groups.

State tech help for digital records

Beginning May 6, 2026, the Division of Technology Services advises the State Archives on security, cybersecurity, and authentication methods. The division may also help government entities set up approved digital authentication systems.

New county fees for digital recording

Beginning May 6, 2026, counties may charge fees to accept and record digitally authenticated documents. Fees must follow state fee rules. If you record a document digitally, you may pay this fee.
