Beginning May 6, 2026, you can raise a new legal defense in civil cases. It applies when a statute, rule, permit, license, order, or other written approval with the force of law from a government entity authorized or required the conduct. The approval must have been in effect when the act happened, the omission occurred, or the condition first arose. You can use this defense in negligence, strict liability, and other civil claims, but not in product-injury cases. You also cannot use it if the issuing agency has found you materially broke permit terms, exceeded its scope, or got it by fraud. This law does not create new lawsuits, does not remove other defenses, and does not cut the duty to use reasonable care.
