Beginning May 6, 2026, the attorney general has an automatic right to join any district court case where a party files a Rule 24 notice that a statute is unconstitutional. The law also keeps the Legislature’s separate, unconditional right to intervene in these cases.
Beginning May 6, 2026, when a civil case names a state entity or a state official, the attorney general, governor, or Legislature can require a three-judge panel. Only those officials can file the notice when they or their office is a party, and no one can ask a court to review that notice. Three judges are picked at random from different judicial districts; a chief judge runs the case, and all three sit together for trials, injunctions, and motions that could end the case. Normal venue rules do not apply to these panel cases, and Rule 42 timing rules govern the notice. Appeals from the panel, including some interim orders, go straight to the Utah Supreme Court and cannot be sent to the Court of Appeals.
