4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Beginning May 7, 2025, Utah colleges can directly pay athletes for their name, image, or likeness, but payments are optional. Colleges cannot fund these payments with state appropriations or student fees. Covered promotion deals include money or other benefits for promoting businesses, people, products, or services. Athletic groups cannot block athletes or colleges from sports because athletes receive these payments or hire agents or lawyers. They also cannot block colleges, their marketing partners, or third-party groups from creating or supporting these payment opportunities.
Playing college sports does not make a student athlete an employee of the college they attend under this law. Receiving college payments for use of their name, image, or likeness does not make them an employee either. This rule addresses those two grounds for employment status, not unrelated jobs an athlete holds.
Student athletes and prospective athletes no longer must submit promotion agreements worth more than $600 to colleges before signing. Colleges also no longer must provide a written acknowledgment about conflicts with school policies or state law. This removes paperwork but also ends the required conflict review.
Utah's public-records law exemption covers athlete promotion agreements and now extends to related messages and other materials. It also covers related materials created before May 1, 2024. This protects deal information from public disclosure but limits public access to those records.
