Beginning May 6, 2026, police, prosecutors, courts, and other officials cannot ask or require a victim of a sexual offense to take a polygraph. They also cannot make a polygraph a condition to continue an investigation or case. A victim’s refusal cannot stop an investigation, charges, or prosecution. The law defines a “polygraph examination” as a test that records body signals like pulse or breathing to judge truthfulness, including a lie detector test.
Beginning May 6, 2026, a “child” in this chapter means someone under 18, unless another Utah law sets a different age. Parents, guardians, or custodians get the chapter’s information rights for those children. A “witness” includes someone subpoenaed or likely to be called to testify for the prosecution, even before a case formally starts.
