Beginning May 6, 2026, penalties for retail and service theft are tougher. Taking service worth under $500 is a class B misdemeanor. Retail theft is a second‑degree felony when the item is a firearm or an operable motor vehicle. If three things are true, the judge must order jail and cannot suspend or shorten it: the court suspended a prison sentence or imposed a misdemeanor; the case is a second or later retail‑theft conviction or an equivalent; and the person has a prior illegal‑reentry conviction under 8 U.S.C. 1326. When the mandatory jail rule applies, the jail terms are fixed: 360 days for a felony or class A misdemeanor, 180 days for a class B misdemeanor, and 90 days for a class C misdemeanor.
Beginning May 6, 2026, the law narrows what counts as a service in theft‑of‑service cases. Gas, electricity, water, sewer, and cable TV count only if taken by threat, force, or certain deception not covered elsewhere. Telephone service counts only if taken by threat, force, or certain deception not covered by related sections. This limits when utility or phone use can be charged as theft of service.
Beginning May 6, 2026, people serving a mandatory retail‑theft jail term are not released to federal immigration authorities until they finish that term. They may be transferred to immigration authorities during the 14 days before the final day of the sentence.
