Stronger notice and 30-day challenge rights

From May 6, 2026, agencies must give public notice for dormancy extension hearings, and the notice must tell people they can object. Boards may continue these hearings under the usual rules. Anyone may challenge a project area budget amendment within 30 days after the agency adopts it.

End dates and fund returns for redevelopment areas

Beginning May 6, 2026, a project’s dormancy ends six months after collections end, and the area dissolves then or eight years after approval if collections never began. An agency can extend the dormancy once, for up to two years, after a public hearing and a matching city or county ordinance. When dormancy ends, the agency must return leftover project funds to each taxing entity in proportion to its share. For areas already in dormancy before May 6, 2026, dissolution happens five years after dormancy started. Within 30 days of a dissolution or extension ordinance, the local government must file it and send copies to the county recorder, county auditor, the State Tax Commission, the State Board of Education, and all taxing entities in the area.

Updated labels for older project plans

Beginning May 6, 2026, the law updates how older project plans are labeled. A “post‑June 30, 1993” plan now means one adopted on or after July 1, 1993 and before May 10, 2016. The law also removes the old definition of “active project area.”
