Utah agencies face new environmental rule limits

Beginning May 6, 2026, Utah agencies generally cannot start rulemaking for numeric limits stricter or broader than federal standards. This applies when federal law covers the same or a substantially similar topic. Covered areas include drinking water, water pollution, hazardous substances, contaminated-site cleanup, air quality, and solid or hazardous waste. Without a relevant federal standard, each material’s limits must rest on the best available science and the weight of scientific evidence. Rules meant to protect health, safety, or welfare must show that exposure at or above the limit directly causes clear bodily harm in humans. That link must follow generally accepted scientific or technical practices. When voluntary human-study data are unavailable, animal or cell studies can support limits only with scientifically supported links to human harm. Exceptions cover rules needed for federal approval, state-required site-specific rules, and emergency rules. Rules no stricter or broader than federal standards, equivalent rules, and changes that ease existing rules are also exempt.
