Beginning May 6, 2026, DEQ may use penalty money to repay itself, a local government, or a local health department for extraordinary enforcement costs. To qualify, the local agency must show DEQ asked for help, send timely written notice of the expected cost, and submit documents to support the claim. DEQ writes rules that define what activities and costs qualify and how to file a claim.
Beginning May 6, 2026, the state creates a committee to coordinate environmental programs with local health departments. It includes the DEQ director (or designee), two DEQ appointees, and three local health leaders. The committee reviews funding, rules, and DEQ policies that affect local health departments. It estimates local costs, notes any money to implement, reviews related federal grant applications, and adopts bylaws.
Beginning May 6, 2026, most civil penalties under state environmental laws go to the State General Fund. Before deposit, DEQ may reimburse extraordinary enforcement costs under the new reimbursement process. Some penalties still go to dedicated accounts, including petroleum storage tank penalties, leaking tank penalties, and waste tire and solid waste penalties. Federal law controls if it bars these deposits or requires a different handling.
