New rules for child abuse homicide cases

Beginning May 6, 2026, Utah changes which crimes count as child abuse for the child abuse homicide law. The law lists specific child abuse and child injury crimes, and removes the separate "child torture" offense from that list. A person commits child abuse homicide when they cause the death of someone under 18 and the death results from child abuse under the listed mental states. If the underlying abuse was reckless as defined, it is a first-degree felony. If it was criminally negligent or under the other listed mental states, it is a second-degree felony.
