Patients get clear stem cell notices

Beginning May 6, 2026, providers who offer stem cell therapy that is not FDA‑approved must give you a written notice before treatment. The notice says the therapy is not FDA‑approved and urges you to talk with your main doctor. It must be on at least 8.5×11 paper in 40‑point type and posted at the entrance and where patients can see it. Before treatment, your provider must get your signed consent that explains the treatment, FDA status, risks, benefits, and alternatives, including no treatment. Any ad for the therapy must include the same notice; in print it must match the largest text, and in other ads it must be clearly legible or clearly spoken.

Provider and supplier rules for stem cells

Starting May 6, 2026, suppliers may give human cell or tissue products only to providers whose scope includes stem cell therapy, and only after the provider confirms in writing they will give patients the required notice. The law defines covered stem cell therapy as treatments using afterbirth placental or other human cell or tissue products, not cells taken from a fetus or embryo after an abortion. The notice and consent rules do not apply in FDA‑approved investigational trials or when the provider works for an accredited institution named in the law. Breaking these rules is unprofessional conduct and can lead to discipline.
