Beginning May 6, 2026, judges can cut how long a person must wait before parole in these later homicide cases. The person must have been convicted before and served prison time, and the judge must find it is in the interest of justice. The cut cannot be more than the time already served on the earlier prison sentence. The court cannot grant probation or suspend the sentence under this authority. The parole board may also credit time already served on the earlier case toward the new prison term.
Beginning May 6, 2026, prosecutors can file a new homicide case when a person later dies from injuries in an earlier case. The earlier case must have ended in a conviction or a dismissal without prejudice, and the injury must be the cause of death. The death must happen within 10 years after the earlier case ended. The 10-year limit does not apply if the earlier case was for attempted aggravated murder, attempted murder, first-degree aggravated child abuse, or child torture. In these later cases, prosecutors may only bring homicide charges. The law also lists which crimes count as homicide and uses the state’s standard meaning of “serious bodily injury.”
