Enforcement and appeal rules for charitable gaming

The Department can deny, suspend, or revoke a charitable or electronic gaming permit when a group is not in strict compliance with the law or its rules. Before acting, it must send written notice with the reasons and the time and place for a hearing, except in cases named in §§ 8.01-534, 18.2-340.25, 18.2-340.30, 18.2-340.30:2, and 18.2-340.36. A hearing may be run by an independent hearing officer from the Supreme Court’s list, and after the hearing the Department may still refuse, suspend, or revoke. Any person harmed by the decision can seek review under the Administrative Process Act (Article 4, § 2.2-4025 et seq.). Losing a permit stops gaming and can cut off funds.
