Summary

Virginia Sexual and Domestic Violence Victim Fund; additional fee for certain offenses. Provides that the clerk shall assess a fee of $500 for conviction of certain offenses outlined in the bill. The bill requires such fees to be credited to the Virginia Sexual and Domestic Violence Victim Fund and designated for funding support services for eligible victims. This bill is identical to SB 329.

New fund for victims and prosecutions

The law creates the Virginia Sexual and Domestic Violence Victim Fund, run by the Department of Criminal Justice Services. A portion of set court assessments is deposited into the Fund. Money left after the two-year budget period stays in the Fund, and interest stays too. Grants can support local prosecutors, law enforcement, civil legal aid, child advocacy, and sexual assault service providers and hospitals. Funding can pay for salaries and equipment for sexual assault forensic and nurse examiners, with priority for rural or underserved areas.

Added $500 court cost for certain offenses

The court adds a $500 fee for each conviction of certain listed crimes. This is on top of other court costs. Examples include kidnapping, sexual assault, prostitution or solicitation, incest, and child sexual abuse or exploitation. All fees go to the Virginia Sexual and Domestic Violence Victim Fund to support victim services.
