Sponsored By: Gretchen M. Bulova (Democratic)

Signed by Governor

Summary

Charter; City of Fairfax; financial powers; elections; compensation for members of boards or commissions. Amends the charter for the City of Fairfax by replacing a cap on the transient occupancy tax with a reference to general law. The bill also amends the charter to align it with current law requiring municipal elections to be held at the November general election. Finally, the bill removes the limit of $50 per meeting for compensation of members of boards and commissions and provides that such compensation is in such amounts as established by the City Council. This bill is identical to SB 581.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Fairfax board members can receive higher pay

The law removes the $50-per-meeting pay cap for Fairfax city board and commission members. The City Council can set compensation above that former limit. The law does not set a new amount or require payment.

Fairfax voters elect city leaders in November

Fairfax’s mayor and City Council elections follow the November general election schedule instead of the former May schedule. Beginning with the 2022 election, elections occur every two years on the first Tuesday after the first Monday in November. Terms begin January 1 after each election. The law also confirms elections held under the earlier charter rules.

Fairfax lodging guests face possible higher taxes

The law removes Fairfax’s 4% lodging tax cap for hotels, motels, and boarding houses. The City Council sets the tax by ordinance, subject to Virginia law. Guests can face higher taxes if the Council raises the rate; this law sets no new rate. Rooms rented for continuous stays of 30 or more days remain exempt.
