New limits for nitrous oxide buyers

Virginia bans selling, distributing, or offering nitrous oxide containers over eight grams to buyers without an exemption. Buyers without an exemption also cannot buy or try to buy these containers. The law also bans sales, distribution, and offers of direct-inhalation devices and flavored nitrous oxide to people without an exemption. The device restriction now extends beyond buyers under 18, but excludes devices containing gas made unfit for human consumption. The flavor ban covers food- or drink-like tastes or smells, including those advertised, noticeable before or during use. Exemptions cover health care providers; catering-supply, food-processing-equipment, and food-service-equipment businesses; and compressed-gas businesses serving industry, manufacturing, or research. They also cover colleges and research institutions for science or education, aerospace manufacturing or propulsion businesses, and food-propellant uses in restaurants, food and beverage services, or houseware products. Automotive-performance equipment sellers, distributors, and installers qualify only when the gas is made unfit for human consumption. Violations are Class 1 misdemeanors.
