Summary

Charter; City of Hopewell; Hopewell Water Renewal Commission. Changes the membership makeup of the Hopewell Water Renewal Commission (the Commission) by providing that up to seven members shall be selected from nominees submitted by users, with each user being permitted to nominate one member. The bill specifies that each new nominating user shall provide a reasonable, market-based capital contribution based on expected facility usage and consistent with the net present value of the existing users' prior capital contributions. The bill also establishes that, in order for actions or decisions made by the Commission to be effective, they must be agreed to by (i) a majority of its members and (ii) either the city manager or the member of the city council serving on the Commission. Finally, the bill removes the city council's authority to overrule actions of the Commission and to prescribe further duties to the Commission.

Users help guide Hopewell wastewater operations

The Hopewell Water Renewal Commission oversees the city-owned regional facility treating sanitary and industrial waste from Hopewell and nearby areas. It can direct financing, design, construction, improvements, repairs, maintenance, operations, and expansion. The commission has up to nine members: up to seven user nominees, a city councilor, and the city manager. The city attorney is not included. Users qualify to nominate one member each by helping plan or finance the facility, or by being current or future users. A majority of the city council appoints members, who need not live in Hopewell. The council must promptly fill vacant appointed seats from the same source for the rest of the term. Governance contracts can provide for manufacturer nominees and preserve manufacturers’ majority representation. Every commission action needs both a majority of its members and agreement from the city manager or a city council member.

New nominating wastewater users must contribute

New nominating users must make a capital contribution, including users whose predecessors never submitted commission nominations. The contribution must be reasonable, market-based, and tied to expected facility use. It must also match the net present value, or today’s value, of existing users’ past capital contributions. The city council agrees to the amount after the commission recommends it. The law sets no specific dollar amount or formula.
