Summary

Apple Board; repeal. Repeals the Apple Board and Apple Fund effective July 1, 2028, and provides that any funds remaining in the Apple Fund as of July 1, 2028, shall be transferred to the Governor's Agriculture and Forestry Industries Development Fund. The bill provides that the excise tax levied on apples grown in the Commonwealth shall not be collected for the 2026 harvest season and requires the chair of the Apple Board to file a report with the Commissioner of Agriculture and Consumer Services no later than June 30, 2028, with a statement of total receipts and disbursements of the Apple Board for the fiscal year ending June 30, 2028. This bill is identical to HB 65.

Apple excise tax ends July 2026

Starting July 1, 2026, the apple excise on Virginia-grown apples is no longer collected. Apple producers and entities that handled it no longer pay or remit this tax. The law does not state the dollar amount of savings.

Apple Board ends; funds shift 2028

The Apple Board is abolished on July 1, 2028. No new appointments are made after July 1, 2026. Current members serve until July 1, 2028, and the Agriculture Commissioner may only fill unexpired terms. On July 1, 2028, any money left in the Apple Fund moves to the Governor’s Agriculture and Forestry Industries Development Fund. Some growers save on board-related costs, while others lose services the Board provided.
