School districts and local health departments must have a physician, physician assistant, or advanced practice nurse prescriber supervise immunization clinics. The supervisor must issue written orders and follow the state health department’s written protocols. If the supervisor is unpaid, not an employee, and follows the protocols, the law treats them as a state agent with state legal defense and liability protection. The state health department can disapprove or require removal of a chosen supervisor.
Legal protection for unpaid public health clinicians
The law treats certain unpaid clinicians as state agents when they volunteer for local health departments or school immunization clinics. They must not be employees and must receive no pay for that work. They can get legal defense from the attorney general and state liability protection for those services. Protection applies only while doing unpaid duties that require medical oversight.
