More legal protection for volunteer health providers
Unpaid physician assistants and advanced practice nurse prescribers get state-agent protection for local health department services requiring medical oversight. They must not be employees of that department. Physicians, physician assistants, and advanced practice nurse prescribers also qualify when supervising local health department or school district immunization programs. These supervisors must be unpaid, follow written state health protocols, and not be county, city, village, or school district employees. State-agent status covers requests for attorney general defense, state claims procedures, and possible state payment of judgments and costs.
More supervisor choices for local vaccine programs
School districts and local health departments can select physician assistants or advanced practice nurse prescribers, as well as physicians, to supervise immunization programs. The supervisor issues written vaccine orders that must follow Wisconsin Department of Health Services protocols. The department can reject the selection or require the supervisor's removal.
