2 provisions identified: 1 benefits, 0 costs, 1 mixed.
Eligible retired West Virginia teachers and bus operators can work unlimited substitute days each fiscal year without reducing monthly retirement benefits. Counties need a State Board-approved shortage policy, renewed annually, and no available, qualified nonretired worker who accepts the assignment. Before retirees exceed normal post-retirement work limits, superintendents must submit an affidavit and the State Board must verify compliance and eligibility. The retirement board also verifies eligibility. This temporary, part-time work provides no new pension credit, employer pension contributions, regular employee benefits, or seniority. Retirees who start work in the fiscal year they retire lose the annuity-reserve portion of their pension benefits. That loss runs from their first workday through the month after substitute service ends. To fill a vacancy without that loss, retirement must take effect before July 1 preceding the fiscal year of employment. The State Board must report annually by February 1 on program results and retiree employment beyond normal limits. These provisions expire June 30, 2030.
Counties must keep vacancies filled by retired critical-needs substitutes posted until qualified regular teachers or bus operators fill them. Online postings must be easy for job seekers to find. Teaching vacancies require posting at the school year's start and mid-year; bus vacancies at the year's start and mid-year. Exceptions cover a regular worker's leave or a job accepted by a qualified regular worker who is not yet available. These posting rules expire June 30, 2030.
