Faster tribal notice on siting permits

Starting July 1, 2025, the director must give nearby tribal governments fast notice on industrial siting permits and waivers. The law defines “tribal government” as the Eastern Shoshone, Northern Arapaho, and the cooperative tribal governing body. Within 7 days of a waiver request, tribes in the same or an adjacent county must get notice. Within 14 days, the director must send a meeting notice; within 50 days, a hearing notice—to the applicant, those tribes, and local governments. For some project types named in W.S. 35-12-102(a)(vii)(E)-(G), affected landowners also get those notices. For permit filings, tribes must get the application within 10 days and a hearing notice within 90 days.

These notice rules apply to permit applications filed on or after July 1, 2025. The Industrial Siting Council must write rules to carry out the law. The rulemaking mandate takes effect immediately, so rules can be ready before July 1, 2025.
