Higher cap to pay minors directly

Beginning July 1, 2025, anyone who owes money or property to a minor with no conservator can pay or deliver up to $25,000 per year directly, up from $5,000. You cannot use this rule if a conservator exists or you know a conservatorship case is pending.

Parents can hold up to $25,000 for a child

Beginning July 1, 2025, a custodial parent can receive up to $25,000 in money or property to hold for a child who has no guardian of the estate, up from $3,000. The parent must swear in writing that the child's total estate is $25,000 or less. The parent must use the money for the child. The parent's written receipt counts as proof of payment.

Settle a child's claim without court

Beginning July 1, 2025, a parent, guardian, or conservator can settle a child's claim up to $25,000 without court approval. This applies only if no guardian or conservator was already appointed for the child and the child is not emancipated. The money must be paid to the parent, guardian, or conservator or into a trust or account for the child. The adult must sign an affidavit saying they made a reasonable check, the total claim is $25,000 or less (not counting fees and costs), and the child is fully compensated or unlikely to get more. The money must be used for the child's benefit. The settlement becomes final and binding when the adult signs for the child—no court review. These rules apply only to settlements entered on or after July 1, 2025.

Penalties for misusing a child's settlement

Beginning July 1, 2025, a child can sue a parent, guardian, or conservator who mishandles settlement money or breaks the new rules. This includes failing to use the money only for the child, not making a reasonable check of the claim, or falsely saying the claim is $25,000 or less. This right applies only to settlements made under the no-court process after that date.
