Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 2 costs, 2 mixed.

Insurer groups must report cash risks

Beginning July 1, 2025, covered insurer groups must report stress tests measuring their ability to meet cash needs. The top controlling person files results with the lead state regulator using National Association of Insurance Commissioners instructions and forms. Insurers generally qualify by meeting at least one framework threshold; meeting none generally places them outside the requirement. The regulator can change that decision after consulting the association's Financial Stability Task Force. Coverage criteria receive review at least yearly, and adopted framework or measurement-year changes take effect January 1 of the following year.

New yearly capital reports for insurers

Beginning July 1, 2025, covered insurance groups must file yearly group capital calculations and ratios with their lead state regulator. The top controlling person files with the registration, following National Association of Insurance Commissioners instructions; regulators can allow another controlling person to file. Exemptions cover single-insurer groups doing only in-state business and accepting no business from other insurers. Other exemptions cover comparable Federal Reserve oversight with shareable results, qualifying foreign oversight, and groups providing information meeting association standards. Regulators can require reports for oversight reasons, grant exemptions, or accept limited reports. Groups losing an exemption must file at the next annual deadline unless granted more time. The usual 0.5% threshold for treating registration transactions as not material does not excuse capital or liquidity test disclosures.

Insurer risk data gets privacy protections

Beginning July 1, 2025, Wyoming keeps reported insurer capital and liquidity data, and specified federal or foreign supervisory information, confidential. These records generally are not public records and cannot be subpoenaed, discovered, or used in private civil lawsuits. Sharing agreements with the National Association of Insurance Commissioners or designated consultants must protect security, state ownership, and permitted uses. They must require prompt notice of disclosure requests and allow insurers to intervene in cases seeking disclosure. Agreements generally restrict permanent database storage after analysis, but exclude liquidity stress test reports from that restriction. Insurers must learn the identity of consultants handling liquidity test reports. The commissioner can publish information only when legally authorized and serving policyholders, shareholders, or the public.

Limits on public insurer risk claims

Beginning July 1, 2025, regulators use group capital and liquidity test information to assess insurer-group risks, not rank insurers publicly. The law generally bars public claims about group capital calculations, ratios, liquidity test results, and supporting disclosures. Violations are treated as misleading. An insurer can publish a written response solely to rebut a materially false statement or inappropriate comparison. It must give the commissioner substantial proof that the statement is false or the comparison inappropriate.
