Clearer notice and lasting protection for victims
These rules cover Wyoming stalking, sexual-assault, and domestic-abuse petitions filed on or after July 1, 2025. Orders are filed with the court clerk and sent to the sheriff, who notifies local law enforcement in the petitioner's county. The person named in an order must be personally served unless they or their lawyer attended when it was granted, including remotely. Orders last up to three years, with extensions of up to three years each when a clear and present danger continues. Extension orders are mailed by both certified and first-class mail to the person's last known address on file with the clerk. That mailing counts as valid notice. Protection stays in place during incarceration, while the remaining term is paused. After release, protection lasts for the remaining term measured when incarceration began, or one year, whichever is longer. Filing for divorce does not override an existing protection order.
More filing and legal help for victims
For Wyoming petitions filed on or after July 1, 2025, victims get more filing and legal-help options. Domestic-abuse victims can file themselves, or a district attorney can file with their consent. A legally authorized representative can file for a minor, vulnerable adult, or adult unable to file because of age, disability, health, or inaccessibility. Courts may appoint lawyers for domestic-abuse victims. For stalking or sexual-assault victims, appointment requires that the district attorney did not file the petition; the former indigency requirement is removed. Appointment is not guaranteed, and victims can still hire a lawyer or file without one. The attorney general prepares standard forms, available free through court clerks; the victim services division provides domestic-abuse forms and instructions.
Victims get more protection order venues
These rules apply to Wyoming protection-order petitions filed on or after July 1, 2025. Victims of stalking, sexual assault, or domestic abuse can file in circuit court where either person lives or is found. They can also file in the county where the act happened. The law removes the domestic-abuse filing option in district court when a county has no circuit court.
