Members of the Foreign Service Pension System can retire and get annuity payments under the System’s rules. A “participant” means a member of that Pension System, and the “System” means the Foreign Service Pension System. If a participant retires (voluntarily or by requirement) and has at least 5 years in the Foreign Service, they qualify for an immediate annuity. Pay for annuity calculations for anyone stationed outside the continental U.S. is treated as if they were paid the Washington, D.C. salary, including D.C. locality pay. The annuity is figured using two different formulas: one applies to service while in the System and certain prior service, and a different rate applies to other service, including years beyond 20. If someone is involuntarily separated and would otherwise get a refund or deferred annuity under another system, they will instead get the involuntary-separation benefits under this System. Disability annuities are calculated using the Foreign Service formula instead of the general civil service formula, and if the person meets age and service rules for an immediate annuity when it starts, that formula applies too. A former participant due a deferred annuity who has 20 years of service under this part and is at least 50 when the annuity begins is not subject to a certain reduction rule that might otherwise apply. A surviving spouse gets 50% of the annuity as computed under the Foreign Service rules, and any “assumed annuity” calculations use the Foreign Service version. Participants who qualify for an immediate annuity also get an annuity supplement until age 62, figured like the supplement for retired law enforcement officers. A person separated for cause who was found disloyal to the United States gets no annuity.
