Title 7 › CHAPTER 26 — AGRICULTURAL ADJUSTMENT › SUBCHAPTER III — COMMODITY BENEFITS › § 612c–6
"Section 32" here means section 32 of the Act of August 24, 1935 (7 U.S.C. 612c). Money that is made available for section 32 and that is more than the yearly cap must be moved to the Secretary of Agriculture, through the Food and Nutrition Service, to run the Richard B. Russell National School Lunch Act programs (but not section 21) and the Child Nutrition Act programs (but not sections 17 and 21). The yearly cap is the total of two things: (A) a fixed dollar amount for each year — $1,173,000,000 for FY2009; $1,199,000,000 for FY2010; $1,215,000,000 for FY2011; $1,231,000,000 for FY2012; $1,248,000,000 for FY2013; $1,266,000,000 for FY2014; $1,284,000,000 for FY2015; $1,303,000,000 for FY2016; $1,322,000,000 for FY2017; and for FY2018 and later the prior year amount adjusted by the Consumer Price Index for All Urban Consumers for the 12‑month period ending on the preceding November 30; and (B) any amounts moved in that year from section 32 to the Department of Commerce under the Fish and Wildlife Act of 1956. Part of the amounts moved under (A) must go to the fresh fruit and vegetable program in the School Lunch Act, in the amounts that law specifies. Also, $4,000,000 from those amounts must be used for whole grain products for fiscal year 2009. These transfers must add to existing federal funding and not replace other federal support for the School Lunch Act programs (except section 19), the Emergency Food Assistance Act, and the program under section 2036.
