"Section 32" means the part of the 1935 law found at 7 U.S.C. 612c. Any money made available under Section 32 in a fiscal year that is more than the year's cap must be sent to the U.S. Department of Agriculture, through the Food and Nutrition Service, to fund the Richard B. Russell National School Lunch Act (except section 21) and the Child Nutrition Act of 1966 (except sections 17 and 21). The yearly caps are: FY2009 $1,173,000,000; FY2010 $1,199,000,000; FY2011 $1,215,000,000; FY2012 $1,231,000,000; FY2013 $1,248,000,000; FY2014 $1,266,000,000; FY2015 $1,284,000,000; FY2016 $1,303,000,000; FY2017 $1,322,000,000. For FY2018 and later, the cap is the prior year's amount adjusted by the change in the Consumer Price Index for All Urban Consumers for the 12 months ending on the previous November 30. The cap also includes any transfers that year from Section 32 to the Department of Commerce under the Fish and Wildlife Act. From the money counted under the cap, the USDA must send the required amounts to the Fresh Fruit and Vegetable Program. The USDA also must use $4,000,000 of those funds in FY2009 for the program at 42 U.S.C. 1755a. These specific transfers must add to other federal funding for the National School Lunch Act (except the Fresh Fruit and Vegetable Program), the Emergency Food Assistance Act of 1983, and section 2036 of this title — they cannot replace other federal funds.
