Federal grants may be denied for noncompliance
The Secretary of Education and other agency heads will make certification of compliance with 20 U.S.C. 1011f material to receiving Federal grant funds under 31 U.S.C. 3729, and Federal grant funds shall not be provided in cases of noncompliance. This links foreign-funding disclosure compliance directly to eligibility for federal grants.
Education Dept. audits and legal enforcement escalate
The Secretary of Education, working with the Attorney General and other agency heads, is directed to conduct audits and investigations and to hold institutions accountable for failures to disclose foreign funding. The order directs seeking enforcement through appropriate action by the Attorney General.
Universities must disclose true foreign funding
Higher education institutions must more specifically disclose details about foreign funding, including the true source and purpose, under section 117 of the Higher Education Act (20 U.S.C. 1011f). The order cites past failures (a study finding more than half of reportable gifts undisclosed from 2010–2016 and $6.5 billion reported after 19 campus investigations in 2019–2021) and directs the Secretary of Education to require complete and timely disclosures.
