Summary

Charter; City of Hopewell; Hopewell Water Renewal Commission. Changes the membership makeup of the Hopewell Water Renewal Commission (the Commission) by providing that up to seven members shall be selected from nominees submitted by users, with each user being permitted to nominate one member. The bill specifies that each new nominating user shall provide a reasonable, market-based capital contribution based on expected facility usage and consistent with the net present value of the existing users' prior capital contributions. The bill also establishes that, in order for actions or decisions made by the Commission to be effective, they must be agreed to by (i) a majority of its members and (ii) either the city manager or the member of the city council serving on the Commission. Finally, the bill removes the city council's authority to overrule actions of the Commission and to prescribe further duties to the Commission.

New buy-in cost for industrial users

Each new nominating manufacturer or other new user that has not nominated before must make a reasonable, market-based capital contribution. The amount is set by expected facility use and must match the net present value of what existing users already paid. The Commission recommends an amount, and City Council must agree. This cost applies to businesses seeking nomination rights on the Commission.

Hopewell water commission and oversight

The law creates the Hopewell Water Renewal Commission for the regional wastewater plant. The Commission can direct financing, design, construction, operations, maintenance, and expansion. It runs daily operations, but the City Council can overrule any action. Every decision needs a majority vote and also agreement from the city manager or a City Council member. The City Council can assign more duties over time.

Seats for business users and city officials

The Commission has up to nine members, appointed by a majority of City Council, and they do not have to live in Hopewell. Up to six or seven seats are for nominees from manufacturers or other users that help plan or finance the plant or that use it; each nominating user may name one person. A city councilor, the city manager, and the city attorney also serve as members. The City may sign enforceable contracts with manufacturers to appoint their nominees and maintain their majority representation. If a seat becomes vacant, City Council fills the rest of the term the same way as the original.
