Beginning July 1, 2025, prescribers can legally write FDA-approved drugs for off-label uses. Pharmacists can fill them if the prescription is valid and within their scope. The law does not allow Schedule I or II controlled substances. It also bars drugs meant to transition a minor's sex or affirm a perception of sex that differs from biological sex. It also bars drugs meant to induce an abortion. The law also defines who counts as a prescriber and a pharmacist.
Starting July 1, 2025, the State Board of Medicine, Board of Dental Examiners, Board of Examiners in Optometry, Board of Nursing, and Board of Pharmacy must write rules to carry out this law. The law takes effect July 1, 2025.
Starting July 1, 2025, licensing boards cannot punish a prescriber or pharmacist only for prescribing or dispensing an FDA-approved drug for an off-label use under this law. Also, a provider's treatment recommendation, prescription, use, or opinion that is not regulated by a health-related licensing board, the Department of Health, a professional association, or the FDA is not unprofessional conduct.
